1. No purchase is necessary to enter the giveaway.
2. This giveaway is open to residents in the following countries: Albania, Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Faroe Islands, Finland, France, Germany, Gibraltar, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Netherlands, Norway, Poland, Portugal, Romania, San Marino, Serbia, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Ukraine, United Kingdom, Canada, United States, Brazil, Chile, Australia, New Zealand, South Africa, Mauritius aged 18 years or over. Employees of Promoter, its parent company, subsidiaries, affiliates or other parties, including but not limited to North Actionsports B.V. brands, FreeWing, StarBoard, Lift Foils and Indiana Paddle & Surf. as well as the immediate family (spouse, parents, siblings, children) and household members of each such employee and/or authors, are not eligible to participate in the Promotion.
3. This giveaway will commence at 24 July 2025 11:30am UTC and all entries must be received by 11:29am on the closing day of each respective prize. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the relevant closing date for any reason. Proof of sending is not proof of receipt. Entries via agents or third parties are invalid.
4. Entrants may enter the giveaway once. If the same user attempts to enter multiple times using different email addresses or methods, they will be disqualified and removed from the giveaway.
5. To enter, entrants agree to be signed up to the marketing mailing lists of Foiling Magazine, all North Actionsports B.V. brands, FreeWing, StarBoard, Lift Foils and Indiana Paddle & Surf.
6. The Promoter's decision is final. No correspondence will be entered into.
7. The prizes are non-transferable and no cash alternative will be offered.
8. Prizes are subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.
9. The winners will be notified via email within 2 working days of each respective prize draw. The winner of each prize must claim their prize within 2 working days of the Promoter sending notification. If the prize is unclaimed after this time, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules. Winners may be required to provide proof of eligibility and age verification before prizes are awarded.
10. To obtain details of the winner please email hello@thefoilingmagazine.com stating the name of the giveaway in the subject heading 4 weeks after the closing date.
11. By entering this giveaway, all entrants consent to the use of their personal data by the Promoter for the purposes of the administration of this giveaway and any other purposes to which the entrant has consented, and consent to being added to the Marketing Mailing lists of Foiling magazine, all North Actionsports B.V. brands, FreeWing, StarBoard, Lift Foils and Indiana Paddle & Surf and agree to accept marketing emails from Foiling Magazine, all North Actionsports B.V. brands, FreeWing, StarBoard, Lift Foils and Indiana Paddle & Surf.. Each brand handles your data in accordance with their respective privacy policy. You can unsubscribe at any time.
12. The Promoter will not give out or sell any data submitted to any 3rd party.
13. This Promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram or TikTok. You acknowledge that all information and material that you submit to enter this Promotion is submitted to the Promoter and not Facebook, Instagram or TikTok and you agree that Facebook, Instagram or TikTok shall not be liable to you in any way in respect of this Promotion.
14. The main prize winners agree that Foiling Magazine can share their first name and city/country publicly. The winners also agree to send Foiling Magazine hi-resolution photos taken in good light that contain the winner with their prize. The winners further grant Foiling Magazine permission to share this on social media and via other media that Foiling Magazine controls. The winners further agree to take part in reasonable post-event publicity and to the use of their names and photographs in such publicity. Foiling Magazine may use winner content and photographs for up to one year from the date of receipt, and any content shared on social media channels and website may remain published indefinitely.
15. By entering the giveaway each entrant agrees to be bound by these terms and conditions.
16. Force Majeure: The Promoter reserves the right to cancel, modify, or suspend the giveaway due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government regulations, or technical failures.
17. Limitation of Liability: The Promoter's liability is limited to the prize value. Participants enter at their own risk and the Promoter is not liable for any damages, losses, or injuries arising from participation.
18. Data Retention: Personal data will be retained for the duration of the giveaway plus 5 years for legal and administrative purposes, after which it will be deleted in accordance with applicable privacy laws. However, as entrants consent to being added to the marketing mailing lists of Foiling Magazine, all North Actionsports B.V. brands, FreeWing, StarBoard, Lift Foils and Indiana Paddle & Surf, data will continue to be held by each respective brand for marketing purposes until the entrant unsubscribes from each mailing list or submits a data deletion request directly to each brand.
19. Dispute Resolution: Any disputes will be resolved under English law and subject to the exclusive jurisdiction of English courts.
20. Tax Liability: Winners are responsible for any applicable taxes, duties, or fees associated with prize acceptance and ownership.
21. Prize Delivery: Prizes will be shipped within 30 business days of winner confirmation. The Promoter is not responsible for lost, stolen, or damaged shipments once handed to the carrier.
22. Social Media Compliance: This promotion complies with the respective terms of service of social media platforms used for promotion.
